Income Tax Notices

Received an Income Tax Notice? Here's What to Do

A notice from the Income Tax Department is not always a sign of wrongdoing. Most notices only seek clarification. Replying on time with the right documents usually resolves the matter.

New Law – A Key Change

From 1 April 2026, the Income-tax Act, 2025 has replaced the Income-tax Act, 1961.

- Section numbers have changed. For example, old Section 148 (income escaping assessment) is now Section 280.

- The terms "Previous Year / Assessment Year" have been replaced by "Tax Year".

- Proceedings relating to years before April 2026 continue under the old Act.

So, check carefully which Act and which section the notice refers to.

Common Types of Notices

1. Intimation after processing of return: issued when your return does not match the department's computation. It may demand additional tax or reduce your refund.

2. Defective Return Notice: asks you to correct missing information within a specified time.

3. Scrutiny / Inquiry Notice: calls for documents on income, expenses and deductions.

4. Income Escaping Assessment Notice: issued when the department believes income of earlier years was not disclosed.

5. High-value transaction (AIS) communications: issued when large bank deposits, property purchases, share investments etc. are not reflected in your return.

6. Notice of Demand: requires payment of tax.

What to Do Immediately

1. Verify the notice is genuine: use "Authenticate Notice / Order" on incometax.gov.in and enter the DIN mentioned in the notice. Fake notice scams are on the rise.

2. Log in to your account and check the notice under "Pending Actions → e-Proceedings".

3. Note the reply deadline.

4. Check your AIS (Annual Information Statement), Form 26AS / Form 168, bank statements and property documents.

5. Reply online with supporting documents. You may seek an adjournment if needed.

6. If the mistake is genuinely yours, filing an Updated Return and paying the tax can help reduce penalty.

If the Order Goes Against You

1. For an apparent mistake (such as a calculation error) – file a Rectification request online.

2. Against an assessment order – appeal to the Commissioner of Income Tax (Appeals) within the short time limit.

3. Thereafter, the Income Tax Appellate Tribunal (ITAT), and then the High Court.

Appeal deadlines are short; act as soon as you receive the order.

What Not to Do

- Don't ignore the notice – the department may assess your income on its own and also levy penalty.

- Don't click links in emails or SMS and share bank details – the Income Tax Department does not ask for them.

- Don't give speculative explanations for transactions without documents.

Changes under the Income-tax Act, 2025 are being implemented in phases. Read the section and deadline in your notice carefully.
