What to Do When a Cheque Bounces?

If a cheque you received is returned for "insufficient funds", it can become a criminal case. But if you miss the deadlines fixed by law, you may lose the right to file a case.

Which Law?

Negotiable Instruments Act, 1881 – Section 138. It applies only to a cheque given for a legally enforceable debt or liability.

Deadlines

1. Present the cheque to the bank: within 3 months from the cheque date.

2. Send a written Demand Notice: within 30 days of receiving the bank's return memo.

3. Time for the drawer to pay: 15 days from receiving the notice.

4. File the complaint in court: within one month after those 15 days end.

Where to File?

In the court having jurisdiction over the payee's bank branch.

Punishment

Imprisonment up to two years, or a fine up to twice the cheque amount, or both. The court may also order interim compensation of up to 20% while the case is pending (Section 143A).

What You Should Do

- Keep the bank's return memo and the original cheque safely.

- Send the notice by registered post and keep the receipt and acknowledgement card.

- Collect proof of the loan or debt.

- Note all dates carefully; delay is the most common reason cases are lost.
