Bank Loan Cases

(Guarantors)

Bank Loans – What to Do When You Receive a SARFAESI Notice?

Borrowers who have mortgaged their house, shop or factory for a bank loan may receive a "SARFAESI notice" when they default. By understanding the deadlines and acting without panic, there are several ways to protect the property and find a solution.

When Does a Loan Become an NPA?

If an instalment or interest remains unpaid for more than 90 days, the bank classifies the loan as a Non-Performing Asset (NPA). Only then can SARFAESI action begin.

SARFAESI Act, 2002 – The Procedure

1. Demand Notice – Section 13(2): requires payment of dues within 60 days.

2. Objection – Section 13(3A): within these 60 days, you may file a written objection on the amount or details in the notice. The bank must reply with reasons within 15 days.

3. Taking Possession – Section 13(4): if dues are not paid within 60 days, the bank may take possession of the mortgaged property.

4. Auction: before selling the property, the bank must give proper notice to the borrower and publish a public auction notice.

Where SARFAESI Does Not Apply

- Agricultural land.

- Loan amount below ₹1 lakh.

- Where more than 80% of the loan has already been repaid.

Right to Redeem the Property

The borrower has the right to get the property back by paying the entire dues and expenses before the auction notice is published.

Challenging the Action – Debts Recovery Tribunal (DRT)

- If the bank's action is illegal or procedurally wrong, an application can be filed before the DRT under Section 17 within 45 days of the action.

- An appeal against the DRT order lies before the Debts Recovery Appellate Tribunal (DRAT), subject to a pre-deposit.

- For loans of ₹20 lakh and above, the bank may also file a recovery application before the DRT.

Ways to Settle

1. Restructuring: extending the tenure or reducing the instalment amount.

2. One Time Settlement (OTS): negotiate with the bank to close the account for a reduced amount. Get the settlement in writing.

3. Lok Adalat: banks regularly participate in Lok Adalats, where disputes can be settled by compromise. The settlement there is final.

For Guarantors

If the borrower does not pay, the bank can recover the amount from the guarantor too. Understand this before standing as a guarantor.

What You Should Do

- Note the date of receipt of the notice; the 60-day and 45-day deadlines are crucial.

- Request the loan Statement of Account from the bank in writing.

- Keep all communication with the bank in writing.

- Don't ignore the notice; delay can result in losing the property.
