GST Notices

1. GST இணையதளத்தில் (gst.gov.in) உள்நுழைந்து, "Services → User Services → View Notices and Orders" பகுதியில் நோட்டீஸைப் பதிவிறக்குங்கள்.

Received a GST Notice? Don't Panic – Here's What to Do

Many people either panic or ignore a notice from the GST department. Both are mistakes. Most notices can be resolved by replying on time with the right documents.

Who Must Register for GST?

- Supply of goods: annual turnover above ₹40 lakh.

- Supply of services: annual turnover above ₹20 lakh.

- Inter-state supplies, e-commerce sales etc. require registration irrespective of turnover.

Regular Returns

- GSTR-1 – details of outward supplies (sales).

- GSTR-3B – summary return with tax payment.

- GSTR-9 – annual return (depending on turnover).

Delay attracts late fees, and unpaid tax attracts interest at 18% per annum. Non-filing of returns for 6 continuous months may lead to cancellation of registration.

Common Types of Notices

1. ASMT-10 (Scrutiny Notice – Section 61): seeks explanation for discrepancies in returns, e.g., mismatch between GSTR-1 and GSTR-3B.

2. DRC-01 (Show Cause Notice – Section 73 / 74 / 74A): demands tax, interest and penalty for short payment, wrongly availed Input Tax Credit (ITC) etc.

3. REG-17 / REG-03: proposal to cancel registration or seeking clarification on registration.

What to Do Immediately

1. Log in to gst.gov.in and download the notice from "Services → User Services → View Notices and Orders".

2. Note the reply deadline immediately (usually 15 or 30 days).

3. Collect returns, invoices, bank statements and books of account for the relevant period.

4. Identify the reason for the discrepancy and file a written reply with supporting documents.

5. You have the right to seek a personal hearing – mention this in your reply.

6. If tax was genuinely short-paid, paying tax and interest in advance through DRC-03 can reduce or avoid penalty.

Penalty – An Overview

- Non-fraud cases: if tax and interest are paid within 60 days of the notice, penalty is generally waived.

- Cases involving fraud or suppression: penalty can go up to 100% of the tax amount.

If the Order Goes Against You – Appeals

1. First Appeal (Section 107): within 3 months of the order, before the Appellate Authority, with a pre-deposit of 10% of the disputed tax.

2. GST Appellate Tribunal – GSTAT (Section 112): within 3 months of the first appellate order, with an additional pre-deposit of 10%. GSTAT benches for Tamil Nadu are functioning from 2026.

3. Thereafter, the High Court.

What Not to Do

- Don't ignore the notice – an order may be passed without hearing your side.

- Don't wait until the last date.

- Don't send a bare letter without supporting documents.

Since September 2025, GST rates have largely been rationalised into two slabs of 5% and 18%. Please verify the current rate applicable to your goods or services.
